The Montenegrin Court of Appeal has overturned the approval for Do Kwon’s extradition to the United States. This is the third successful appeal by the Terraform Labs co-founder in the extradition process.

Kwon previously obtained similar requests for extradition to the United States and South Korea on December 19 and February 8, respectively.

The Court of Appeal cited procedural issues as the reason for overturning the decision, specifically pointing out the lack of clear reasoning and facts in the High Court’s ruling.

The case will now be sent back to the trial court for a retrial. On March 23, 2023, Kwon and former Terraform Labs CFO Han Chang-joon were arrested by Montenegro police while attempting to fly from Podgorica Airport to Dubai using false passports.

The arrest was made upon the request of law enforcement agencies in the United States, South Korea, and Singapore. Kwon is facing numerous charges by Korean authorities, including violations of capital markets laws.
