CFTC updates guidance on tokenised assets

The CFTC has updated its guidance on tokenised assets and blockchain-based recordkeeping for registered firms.
The updated FAQs clarify that firms can invest customer funds in tokenised assets if they provide the same or functionally equivalent legal and economic rights as traditional assets. The CFTC also said it would not object to blockchain-based recordkeeping.
The update follows the Senate’s failure to advance the CLARITY Act on 15 September. The cloture vote was rejected 49-50.
