CLARITY Act stalls after US Senate vote

The US Senate has failed to advance the CLARITY Act after a procedural vote fell short of the threshold needed to move the crypto market structure bill forward.

The cloture motion failed 49-50 on 15 September, with 60 votes required to proceed to floor debate. The bill would establish a federal regulatory framework for digital assets and set out the respective roles of the Securities and Exchange Commission and Commodity Futures Trading Commission.

The legislation had faced disagreements over ethics provisions covering government officials and their families. It also drew opposition from 18 state attorneys general, who said the proposed framework could restrict states’ ability to pursue crypto fraud and misconduct.

With fewer than 36 Senate business days remaining before the new congressional session begins in 2027, the vote leaves the bill stalled for now.
